The law on regulation of recommendation internet technologies was signed by Russian President Vladimir Putin on July 31, 2023. The document gives Roskomnadzor the right to block recommendation technologies of those platforms that are deliberately used for purposes that do not comply with Russian legislation. The law requiring marketplaces and social networks to notify users about the operation of recommendation technologies will come into force on October 1, 2023. By the end of August, Roskomnadzor will propose for discussion a document regulating the content of notifications.
On August 7, Roskomnadzor developed a document outlining the requirements for the content of information on the use of recommendation technologies and its placement on information resources. Public discussion of the document will last until September 1.
For now, the requirements for Internet platforms for posting information consist of five points: a template of a certain text must be posted on the information resource where recommendation technologies are used; the text is posted on the main page of the resource and on the pages from which personal data is collected, 24/7; access to information must be carried out without additional registration and other restrictions; it is not allowed to overlay information on other information posted on the same resource; in order to inform users, the owner of the resource can ensure that information is posted on a separate page.
The document will come into force after the end of public discussions, but not earlier than October 1, 2023 (the date of entry into force of Federal Law No. 408-FZ "On Amending the Federal Law "On Information, Information Technology and Information Protection").
"The draft document is currently undergoing a public discussion procedure. The comments received will be taken into account when finalizing the document and preparing the final version. As for the measures of responsibility for violating the requirements for the content and placement of information on the use of recommendation technologies, there are currently no such provisions in the legislation," a representative of the press service of Roskomnadzor told a ComNews correspondent.
Deputy Managing Director of the Ozon online store Alexey Minaev noted that the work on the document took place in dialogue with the industry: "The drafters of the requirements took into account the previously indicated comments of the market. The adopted law simultaneously protects the interests of users and allows companies to continue to develop convenient customer-oriented solutions that save time on choosing a particular product or service."
Artem Popov, head of the marketing department of the XCOM-SHOP online store, criticized the law: "I consider the regulation of product recommendations in online trade to be excessive, and the consequence of the discussed bill will most likely be several additional lines in the user agreement, which few people read. But first of all, I would wait for its final version: without understanding the requirements for the content and order of notifications, it is premature to draw any conclusions. Our practice has shown that recommendations based on ML algorithms (machine learning algorithms that analyze customer behavior - ComNews note ) allow us to recommend to customers what they will like and when it is appropriate. In other words, this is not only about user convenience, but also about simplifying the purchasing process."
Pavel Zhitnyuk, CEO of the iTrend communications agency, believes that the new law is another attempt by the state to strengthen control over Internet resources. "Judging by the document, marketplaces and applications will be forced to add a page describing the recommendation technologies and ask the user to read and agree to them, as well as with the user agreement. It seems that there is no big problem for either of them. But in general, this is another logical step towards continuing regulation of the digital space and services by the state. Social networks and media platforms have received too strong tools to influence huge masses of people. It is impossible to ignore this fact, so the struggle for state dominance in this field will only intensify," Pavel Zhitnyuk is sure.
