The agreement concerning the transfer of personal data, also known as Privacy Shield, was annulled on July 16 by the European Court of Justice . This system was used by the majority of companies for the processing of personal data of European users.
ABOUT THE PRIVACY SHIELD AGREEMENT
The Privacy Shield is an agreement that allowed digital oman email list companies to legally transfer the personal data of European citizens to the United States. This includes data such as identity, geolocation, online behavior, etc. The use of data is subject to strict regulation in Europe, but this is not the case in the United States where it is less regulated. The Privacy Shield agreement had provided an exemption to allow American companies to use the data provided that they comply with certain measures.
The agreement was established in July 2016 after the CJEU (European Court of Justice) invalidated the Safe Harbor agreement. The Privacy Shield was the subject of many attacks right after its adoption, notably by an Austrian privacy activist, Max Schrems. According to him, the regulations of the Privacy Shield agreement are nothing compared to those of the European Union.
The complainant adds that the agreement will probably be invalidated by the European courts given the many shortcomings it presents. The G29, which is the gathering of European privacy protection authorities, had also shown its reluctance by expressing its regrets regarding the weak provisions and the redress mechanism, which was difficult to apply.
