Government Resolution No. 6 "On approval of the Rules for making a decision to prohibit or restrict the cross-border transfer of personal data by the authorized body for the protection of the rights of personal data subjects and informing operators about the decision taken" is posted on the official portal. This regulatory legal act (RLA) was prepared in compliance with the new requirements of the legislation on the protection of personal data, and its draft was prepared back in September 2022. The RLA comes into force on March 1.

At the same time, the operator is obliged to ensure that the foreign state to whose territory the PDn is transferred ensures adequate protection of the rights of PDn subjects before the start of the cross-border transfer. Roskomnadzor may also decide to prohibit or restrict the cross-border transfer of PDn based on submissions received from federal executive authorities.

"The main point is that Roskomnadzor's powers are being expanded once again, or rather, new ones are appearing. In principle, control over cross-border data transfer is not a new topic; it is enough to recall the requirements for storing data strictly on Russian servers. However, this control is now being tightened: both informationally (it is necessary to notify) and administratively (Roskomnadzor will monitor), - believes Pavel Katkov, a lawyer, economist, and member of the Committee of the Chamber of Commerce and Industry of the Russian Federation on Entrepreneurship in the Sphere of Media Communications. - How well the document has been developed will become clear when it is put into practice. If there are disputes, including those that reach the court, they will shed light on the inconsistencies - if there are any."

According to Sergey Nazarenko, Head of Big Data at Reksoft, the document brings more clarity to the procedure itself, sets the terms and rules for introducing these restrictions and regulates interaction directly with the PDn operator. For a full assessment of the regulatory legal act, it is necessary to have legal knowledge of law enforcement practice in cases of restricting the transfer of PDn and to consider the entire set of laws and procedures on working with PDn as a whole.
